These terms govern your use of the mobile game Right on Time ("the App") provided by Alexander Linack, Ackerstr. 13A, 85757 Karlsfeld, Germany ("we", "us"). They form a contract between you and us.
Apple Inc. and Google LLC are not parties to this contract. They distribute the App and process payments; their own terms apply to that relationship in addition to these terms.
We grant you a non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your personal, non-commercial use. All rights not expressly granted remain with us.
You may not: reverse engineer, decompile or disassemble the App except to the extent permitted by mandatory law (§ 69e UrhG); circumvent or manipulate the advertising, purchase, timing or scoring mechanisms; distribute modified versions; or use the App in a way that infringes third-party rights or applicable law.
The App is free to download. The free version is financed by advertising: full-screen interstitial ads are shown between sessions, limited by an on-device pacing rule. There are no banner ads and no rewarded ads. Advertising never blocks access to a game mode.
Advertising is delivered by Google AdMob. Details of the data processing involved are set out in our Privacy Policy.
Right on Time Pro (product ID com.rightontime.app.pro) is a one-time, non-consumable in-app purchase. It removes all advertising and unlocks the additional content described in the store listing at the time of purchase.
The contract of sale for the in-app purchase is concluded with the platform operator (Apple or Google), which acts as the seller. The price shown in the store at the time of purchase applies and includes statutory VAT; prices are set per country by the platform operator. Purchases are tied to your Apple or Google account and can be restored on your other devices using the same account.
The App contains no virtual currency and no paid consumables. Scores, streaks and progression have no monetary value, exist only on your device, and cannot be exchanged, sold or paid out.
Because the platform operator is the seller, refunds and the statutory right of withdrawal are handled by that operator:
As a consumer in the EU you have a 14-day right of withdrawal for digital content. This right expires once delivery of the digital content has begun, if you expressly consented to immediate delivery and acknowledged that you thereby lose the right of withdrawal (§ 356 (5) BGB). The platform operator obtains this acknowledgement at the time of purchase.
We develop the App continuously and may add, change or remove features, game modes, themes or ad formats, including introducing additional ad formats in later versions. Where a change materially reduces the scope of content already paid for with Right on Time Pro, we will inform you within the App in reasonable time (§§ 327e, 327r BGB).
We provide updates required to keep the App in conformity with the contract for as long as you may reasonably expect given the type and purpose of the App. Updates may require a current version of iOS or Android; support for older operating system versions may end.
We do not guarantee uninterrupted availability of the advertising services or the app store platforms, as these are operated by third parties.
Game progress, statistics and settings are stored locally on your device only. We operate no server and keep no cloud backup. If you delete the App, reset the device or lose it, this data is lost unless it was included in your own Apple or Google device backup. Your Right on Time Pro purchase is unaffected and can be restored through your Apple or Google account.
Statutory warranty rights for digital products (§§ 327 ff. BGB) apply to Right on Time Pro. For the free version, our liability for defects is limited to intent and gross negligence.
The App measures reaction and timing accuracy. Measurement results depend on your device's hardware, display latency and operating system state. We do not warrant absolute measurement accuracy, and the in-app statistics are provided for entertainment purposes.
We are liable without limitation for damages arising from injury to life, body or health, for intent and gross negligence, and under the German Product Liability Act.
In the case of slight negligence we are liable only for breach of a material contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), and in that case only for the foreseeable damage typical for this type of contract. Any further liability is excluded.
The licence runs for an indefinite period. You may terminate it at any time by deleting the App. We may terminate the licence for good cause, in particular for serious or repeated breaches of section 2.
These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in another EU member state, you retain the protection of the mandatory provisions of the law of that state.
The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Should any provision of these terms be or become invalid, the validity of the remaining provisions is unaffected. We may amend these terms where necessary due to changes in the law, in case law or in the App's functionality; the current version is always available at right-on-time.app/terms.html.
